Terms of Service — Calico Marketplace

These Terms of Service govern your access to and use of the Calico marketplace — available at calico.co.il and associated mobile interfaces (collectively, the Platform). The Platform is operated by Calico Marketplace Ltd., a company registered in Israel. By creating an account or completing a purchase, you agree to these Terms in full. If you do not agree, please do not use the Platform. We have two types of members: Buyers (people who purchase items) and Sellers (verified artists and makers who list items for sale). Some rules apply to both; others are role-specific. Sections are clearly labelled.

You must be at least 18 years old to create an account and make purchases. By using the Platform you confirm that you meet this requirement and that all information you provide is accurate and current. Calico is available internationally, but our primary market is Israel. All prices are displayed in Israeli Shekels (ILS) unless you select another display currency. The definitive transaction currency is ILS.

Every seller on Calico is a verified, independent artist or maker. To list items for sale you must: 1. Complete the seller onboarding process and provide identity documentation. 2. Confirm that all items you list are original works you have personally created (or, in the case of studios, produced under your direct creative direction). 3. Agree to the Seller-specific rules in these Terms and the Seller Fee Schedule. Resellers, importers of mass-produced goods, and drop-shippers are not permitted on Calico. We reserve the right to remove listings and suspend accounts that do not meet these standards, with or without prior notice.

Sellers are responsible for the accuracy of all listing information — including photographs, materials, dimensions, weight, and production time. Listings must not misrepresent the item in any material way. Calico may edit, suppress, or remove any listing that violates these Terms or our content guidelines, at our sole discretion.

Calico uses an escrow model for all transactions, operated via our payment partner AllPay. 1. When a buyer completes checkout, payment is held securely in escrow — the seller does not receive funds at this point. 2. Calico notifies the seller of the order; the seller ships within the stated production and dispatch window. 3. Once the buyer confirms delivery and acceptance (or after a maximum of 14 calendar days from confirmed delivery without dispute), funds are released to the seller. 4. Calico deducts a 15% platform fee plus the applicable payment processing fee (~1.3%) before releasing the remainder to the seller. Payment processing is handled by AllPay. By making a purchase you also agree to AllPay's terms of service. Calico does not store full card details on its servers.

Sellers set their own shipping options and estimated timelines. Calico facilitates delivery coordination via DelivApp for eligible Israeli addresses; international shipping options are available where listed. Calico is not the shipper and is not liable for carrier delays, customs holds, or loss in transit unless caused directly by a Calico error. Sellers are responsible for packaging items safely and providing accurate tracking information.

If an item arrives damaged, materially different from its listing, or is not delivered, buyers may open a dispute within 14 days of confirmed delivery. Resolution options: - Full refund to the original payment method. - Store credit on the buyer's Calico account (at buyer's election, valued at 110% of the purchase price). Refunds for change-of-mind on non-defective, correctly described items are at the seller's discretion. Custom or made-to-order items may not be eligible for return unless defective.

Sellers retain full copyright over the works they create and list. By listing on Calico, sellers grant Calico a non-exclusive, royalty-free licence to display, reproduce, and promote images of those works for marketing and platform purposes. This licence ends if the listing is removed and Calico has had reasonable time to update its materials. Buyers receive ownership of the physical item purchased. No copyright or reproduction rights are transferred unless explicitly stated in the listing. All Calico branding, platform design, and software remain the exclusive property of Calico Marketplace Ltd.

You agree not to: - List or purchase items that are illegal under Israeli law or the laws applicable to the buyer's jurisdiction. - Attempt to conduct transactions off-platform to circumvent escrow or fees. - Impersonate another artist, buyer, or Calico representative. - Use automated tools to scrape, spam, or manipulate the Platform. - Post false reviews, ratings, or testimonials. - Upload content that is defamatory, obscene, or infringes third-party rights. Violations may result in account suspension, permanent ban, and referral to appropriate authorities.

To the maximum extent permitted by applicable law, Calico's total liability for any claim arising out of your use of the Platform shall not exceed the amount you paid in the transaction giving rise to the claim, or ILS 500, whichever is greater. Calico is not liable for indirect, incidental, or consequential damages, including lost profits or data loss. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence.

We may update these Terms from time to time. When we do, we will update the Last updated date and notify registered users by email at least 14 days before material changes take effect. Continued use of the Platform after that date constitutes acceptance.

These Terms are governed by the laws of the State of Israel. Any dispute that cannot be resolved by direct negotiation will be submitted to the competent courts of Haifa, Israel, unless mandatory consumer-protection law requires otherwise.
